Terms of Service
Effective date: July 7, 2026
These Terms of Service (the “Terms”) govern your access to and use of MedExpenseHero (the “Service”). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. What the Service is — and is not
MedExpenseHero is a record-keeping and estimation tool. It helps you track medical expenses and estimates amounts that may be relevant to the Canada Revenue Agency (“CRA”) Medical Expense Tax Credit (Lines 33099 and 33199).
- The Service does not provide tax, legal, accounting or financial advice. All calculations, category labels, eligibility indications, threshold amounts, period recommendations, claimant recommendations and credit estimates are automated, informational estimates only. They may be incomplete, out of date or wrong for your situation.
- You are solely responsible for your tax filings. Before relying on any number produced by the Service, verify it against current CRA rules (including guide RC4065) or with a qualified tax professional. Only you (or your authorized representative) file your return, and only you are responsible for its accuracy.
- No professional relationship (tax preparer, accountant, lawyer or otherwise) is created by your use of the Service.
2. No affiliation with the CRA
MedExpenseHero is an independent tool. It is not affiliated with, endorsed by, or connected to the Canada Revenue Agency or the Government of Canada. References to the CRA, its forms, line numbers and guides are descriptive only.
3. Eligibility and accounts
- You must be at least the age of majority in your province or territory of residence to create an account.
- You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
- You must provide accurate information, and you are responsible for the accuracy of all data you enter, including amounts, dates, reimbursements and information about family members.
- By entering information about family members or other individuals, you confirm you are authorized to provide that information.
4. Acceptable use
You agree not to:
- use the Service for any unlawful purpose, including preparing fraudulent claims;
- attempt to access another user’s data or probe, scan or test the Service’s security;
- interfere with or disrupt the operation of the Service;
- reverse engineer, resell or misrepresent the Service as your own.
5. Your content
You retain all rights to the data and documents you upload (including receipts). You grant the Service only the limited rights needed to store, process, display and export that data back to you — nothing more. Handling of personal information is described in the Privacy Policy.
6. Disclaimer of warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OR CONDITIONS OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY OR NON-INFRINGEMENT. WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT: (a) ANY CALCULATION, ESTIMATE OR RECOMMENDATION IS CORRECT, CURRENT OR APPLICABLE TO YOUR CIRCUMSTANCES; (b) THE SERVICE WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE; OR (c) DATA WILL NEVER BE LOST. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
7. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE OPERATOR OF THE SERVICE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE. WITHOUT LIMITING THE FOREGOING, WE ARE NOT LIABLE FOR ANY DENIED, REDUCED, REASSESSED OR PENALIZED TAX CLAIM, ANY INTEREST OR PENALTIES ASSESSED BY THE CRA OR ANY OTHER TAX AUTHORITY, OR ANY DECISION YOU MAKE IN RELIANCE ON THE SERVICE’S ESTIMATES. IN NO EVENT SHALL OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE EXCEED THE GREATER OF (a) THE AMOUNTS YOU PAID FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE AND (b) FIFTY CANADIAN DOLLARS (CAD $50). SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS OF LIABILITY, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
8. Indemnification
You agree to indemnify and hold harmless the operator of the Service from claims, damages and expenses (including reasonable legal fees) arising from your violation of these Terms, your misuse of the Service, or your tax filings.
9. Termination
You may stop using the Service and delete your account (with all of its data) at any time from the Account page. We may suspend or terminate accounts that violate these Terms or create risk for the Service or other users. Sections 1, 2 and 5–8 survive termination.
10. Changes to the Service or these Terms
We may modify the Service or these Terms. Material changes will be indicated by updating the effective date above; continued use of the Service after a change constitutes acceptance. If you do not agree with a change, stop using the Service and delete your account.
11. Governing law
These Terms are governed by the laws of the province or territory of Canada in which the operator of the Service is established, and the federal laws of Canada applicable therein, without regard to conflict-of-law rules. Nothing in these Terms limits any non-waivable consumer rights you may have under the laws of your province or territory.
